Event Terms and Conditions
These Terms and Conditions apply to all persons who register for, attend, participate in, provide services at, or otherwise enter the venue for the event described in the relevant invitation, ticket, registration form, programme, or related event communication.
1. Acceptance of Terms
By registering for, purchasing a ticket to, entering, attending, or participating in the event, each attendee confirms that they have read, understood, and agreed to be bound by these Terms and Conditions. If an attendee does not agree to these Terms and Conditions, they must not attend or participate in the event.
2. Admission and Right of Entry
The organiser reserves the right, in its reasonable discretion, to refuse admission to, remove, or require any attendee to leave the venue where the attendee breaches these Terms and Conditions, fails to comply with lawful venue or organiser instructions, behaves in a disruptive, unsafe, unlawful, or inappropriate manner, or poses a risk to the safety, security, comfort, or enjoyment of others.
3. Venue Conditions and Attendee Responsibilities
Attendees acknowledge that the event may be hosted in both indoor and outdoor areas and that attendance may involve ordinary venue risks, including but not limited to crowding, queueing, limited seating, lighting or sound effects, temporary obstructions, stairs, ramps, wet or slippery surfaces, ventilation conditions, and interaction with other attendees, exhibitors, contractors, suppliers, staff, or service providers. Attendees must take reasonable care for their own safety and possessions and must comply with all venue rules, safety notices, emergency procedures, access controls, and instructions issued by the organiser, venue owner, security personnel, or authorised representatives.
4. Health, Safety and Emergency Measures
Attendees must comply with all venue rules, safety notices, emergency procedures, access controls, and instructions issued by the organiser, the venue owner, landlord, operator, security personnel, or their authorised representatives.
5. Personal Belongings
Attendees remain responsible for their own personal belongings, equipment, devices, valuables, bags, clothing, and other property brought to the event. To the fullest extent permitted by law, the organiser will not be liable for any loss, theft, damage, destruction, or misplacement of personal property, whether occurring inside the venue, in parking areas, cloakrooms, storage areas, exhibition spaces, or any related event area.
6. Event Changes, Cancellation or Interruption
The organiser may postpone, reschedule, relocate, vary, interrupt, suspend, or cancel the event, or amend the programme, speakers, performers, exhibitors, venue layout, capacity, access arrangements, or event format, where reasonably necessary due to operational requirements, venue constraints, safety concerns, technical issues, supplier failure, legal or regulatory requirements, force majeure, or circumstances beyond the organiser’s reasonable control.
7. Disclaimer
The event, venue facilities, programme content, activities, materials, demonstrations, presentations, food and beverages, entertainment, and related services are made available on an “as is” and “as available” basis. While the organiser will take reasonable steps to host the event safely and professionally, the organiser does not warrant that the event will be uninterrupted, error-free, suitable for every attendee’s individual requirements, free from delays, free from third-party conduct, or free from all risks normally associated with indoor public or private gatherings.
8. Limitation of Liability
To the fullest extent permitted by applicable law, the organiser, venue owner, sponsors, partners, employees, contractors, suppliers, agents, volunteers, representatives, and affiliates will not be liable for any direct, indirect, incidental, special, consequential, punitive, or economic loss or damage arising from or connected with the event, including loss of profits, loss of business, loss of opportunity, loss of data, reputational harm, personal inconvenience, emotional distress, travel or accommodation costs, or any loss resulting from delay, cancellation, interruption, venue conditions, third-party conduct, technical failure, theft, damage to property, personal injury, illness, or death, except to the extent that liability cannot lawfully be excluded or limited.
Nothing in these Terms and Conditions is intended to exclude or limit liability where such exclusion or limitation would be unlawful, including liability arising from gross negligence, wilful misconduct, fraud, or any liability that may not be excluded or limited under applicable consumer protection, health and safety, privacy, or other mandatory laws.
9. Indemnity
Each attendee indemnifies and holds harmless the organiser, venue owner, sponsors, partners, employees, contractors, suppliers, agents, volunteers, representatives, and affiliates from and against any claim, demand, liability, loss, damage, cost, or expense, including reasonable legal costs, arising from the attendee’s breach of these Terms and Conditions, unlawful conduct, negligent act or omission, damage to venue property, interference with the rights or safety of others, or failure to comply with venue rules or lawful instructions.
10. Third-Party Services and Content
The event may include or make available services, products, exhibitions, demonstrations, presentations, information, food and beverages, competitions, offers, or promotional materials provided by third parties. The organiser is not responsible for third-party statements, products, services, warranties, representations, acts, omissions, or failures, and attendees engage with third parties at their own discretion and risk, subject to applicable law.
11. Photography, Filming and Media
Photographs, audio recordings, video recordings, livestreams, interviews, or other media may be captured at or in connection with the event for operational, security, record-keeping, marketing, reporting, archival, training, communication, or promotional purposes. By attending the event, attendees acknowledge that they may appear in such media and, where lawful and appropriate, consent to the organiser using such media in connection with the event and the organiser’s related business activities.
Attendees who do not wish to be photographed, filmed, or recorded should notify the organiser in writing before the event or inform an event representative on arrival. The organiser will take reasonable steps to accommodate such requests where practicable, but cannot guarantee exclusion from all background, crowd, incidental, security, or wide-angle footage.
12. Protection of Personal Information Act, 2013 (POPIA)
The organiser may collect and process personal information relating to attendees, including names, contact details, identification or registration information, dietary or accessibility requirements, payment or ticketing information, attendance records, photographs, recordings, communications, and any other information reasonably required for event registration, access control, safety, administration, communication, compliance, reporting, dispute resolution, and related lawful purposes.
The organiser will process personal information in accordance with the Protection of Personal Information Act, 2013, including the applicable conditions for lawful processing, and will take reasonably practicable measures to protect personal information against unauthorised access, loss, misuse, alteration, disclosure, or destruction.
Personal information may be shared with venue operators, ticketing or registration service providers, security providers, medical or emergency responders, payment processors, contractors, suppliers, sponsors, insurers, professional advisers, regulators, law enforcement authorities, or other parties where necessary for the purposes described above, where required by law, or where the attendee has provided consent.
Attendees may have rights under POPIA, including the right to request access to their personal information, request correction or deletion of personal information where legally permitted, object to certain processing, withdraw consent where processing is based on consent, and lodge a complaint with the Information Regulator. Requests relating to personal information should be directed to the organiser’s designated contact person or Information Officer using the contact details provided by the organiser.
13. Direct Marketing and Event Communications
The organiser may send attendees event-related communications, including confirmations, updates, notices, safety information, logistical information, and post-event communications. The organiser will only send direct marketing communications where permitted by law, including where the attendee has consented or where another lawful basis applies. Attendees may opt out of direct marketing communications using the unsubscribe or opt-out mechanism provided, where applicable.
14. Accessibility, Dietary and Special Requirements
Attendees should notify the organiser of any accessibility, dietary, medical, or other special requirements within the timeframe specified by the organiser. The organiser will take reasonable steps to accommodate such requirements where practicable, but cannot guarantee that all requests can be met, particularly where requests are made late or depend on third-party suppliers, venue constraints, or safety considerations.
15. Prohibited Items and Conduct
Unless expressly authorised by the organiser, attendees may not bring into the venue any illegal substances, weapons, hazardous materials, disruptive equipment, unauthorised recording equipment, outside food or beverages, animals other than authorised assistance animals, or any item that the organiser or venue reasonably considers unsafe, unlawful, disruptive, or inappropriate for the event. Smoking, vaping, harassment, discrimination, intimidation, violence, vandalism, unauthorised commercial activity, and interference with event operations are prohibited.
16. Compliance with Laws
Attendees must comply with all applicable laws, regulations, venue policies, security requirements, health and safety requirements, and reasonable instructions issued in connection with the event. These Terms and Conditions are subject to applicable South African law and do not limit any rights or obligations that cannot lawfully be limited.
17. Governing Law and Disputes
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute arising from or relating to the event or these Terms and Conditions will, where possible, first be addressed through good-faith engagement between the attendee and the organiser. If the dispute cannot be resolved informally, it may be referred to the competent courts or other appropriate forum having jurisdiction under applicable law.
18. General
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law. The organiser’s failure to enforce any provision does not constitute a waiver of its rights. The organiser may update these Terms and Conditions where reasonably necessary, and the updated version will apply from the date made available or communicated to attendees.
